Unemployment overpayment appeal deadlines: the shortest windows in America
Every state lets you appeal an overpayment. None of them give you long. The clock starts on the date printed on the notice — mail time is your problem, not the state's — and when the window closes, the debt usually becomes final even if the state made the mistake.
The five shortest
- West Virginia — 8 days. The shortest window in the country, and West Virginia offers no waiver either. A WV notice is a same-week emergency.
- Hawaii, Iowa, Indiana, Massachusetts, Montana, South Carolina — 10 days. Ten days from the printed date can be six days from your mailbox.
- Nevada — 11 days. An odd number that catches people assuming "two weeks."
- North Dakota — 12 days.
- Texas, Wisconsin, Idaho — 14 days. Texas is the trap inside the trap: its waiver covers federal programs only, so the 14-day appeal is the whole game for regular claims.
Where the traps hide
- The number you Googled may be the wrong deadline. Several states publish a general appeal deadline that differs from the overpayment one — Oklahoma's is 20 days for overpayments (not the general 10), Maryland's is 30 (not 15), Delaware's rose to 15 while some agency pages still say 10. Our state table uses the overpayment-specific rule from the agency or statute.
- Waiver deadlines can be separate. South Carolina wants the waiver application within 10 days of the notice; Georgia's waiver request window is 15 days — even where the appeal window is longer.
- "Days" usually means calendar days. Louisiana is the notable business-day exception in our research. Weekends count against you almost everywhere.
If you're already late
File anyway, today, with a one-paragraph good-cause explanation: the notice never arrived, it went to an old address, you were hospitalized, the agency told you the wrong deadline. Late appeals with good cause are accepted in many states — and a waiver request may still be open even when the appeal has closed. The only filing that can never win is the one never sent.
